4. Deposits, Project Inactivity, and Reactivation

All deposits and initial project payments made to New Media Agency, Inc. are non-refundable.

Deposits are used to reserve production time, allocate personnel and resources, schedule the project, and begin research, planning, strategy, design, development, content creation, technical setup, or other services.

Deposits will not be refunded if the client:

  • Cancels the project
  • Changes direction
  • Delays the project
  • Decides not to proceed
  • Fails to provide required materials
  • Fails to provide feedback or approvals
  • Becomes unavailable or unresponsive
  • Otherwise prevents New Media Agency from continuing the work

This policy applies except where a refund is expressly required by applicable law or agreed to by New Media Agency in writing.

Clients are responsible for responding to requests for information, materials, access credentials, content, feedback, approvals, and decisions within a reasonable period.

If a client stops responding or fails to provide the information necessary to continue the project for more than 30 consecutive calendar days, New Media Agency may classify the project as inactive and archive it.

Once a project is archived:

  • Previously agreed timelines, deadlines, and launch dates will no longer apply.
  • The project will be removed from the active production schedule.
  • The project will be rescheduled based on New Media Agency’s current availability.
  • A reactivation fee must be agreed upon and paid before work resumes.
  • Any outstanding invoices must be paid before the project is reactivated.
  • The project scope, pricing, timeline, technical requirements, and remaining deliverables may be reviewed and updated.
  • Additional fees may apply when software, platforms, vendors, requirements, or project conditions have changed during the inactive period.

New Media Agency is not responsible for delays, additional costs, expired software, discontinued services, lost third-party access, platform changes, technical incompatibilities, or other circumstances arising while a project is inactive.

Reactivation of an archived project is subject to New Media Agency’s availability and written approval.

5. AI-Assisted Services and Technology

New Media Agency may use artificial intelligence, machine learning, automation, and other digital tools to support its services and internal operations.

These tools may be used to:

  • Organize and analyze project information
  • Research markets, competitors, audiences, and industry trends
  • Draft, edit, summarize, translate, or improve content
  • Develop marketing strategies and campaign recommendations
